Kapseret MP Oscar Sudi has been acquitted of charges against him over alleged insult of former First Lady Mama Ngina Kenyatta.
Chief Magistrate Isaac Orenge, in a Friday ruling at a Nakuru court, stated that the evidence presented in the case was not substantial to convict Sudi.
“I have considered the evidence of all the witnesses. There were no witnesses who stated what effect the words uttered had on them,” said the Magistrate.
Magistrate Orenge faulted the prosecution over failure to present evidence to prove that Sudi’s comments ignited ethnic tensions.
“In a matter where it is alleged that the act was intended to provoke a breach of peace, the prosecution is duty-bound to prove beyond reasonable doubt that the act complained of was likely to make people resort to physical violence,” he ruled.
The legislator was in September 2020 charged with two counts of hate speech and offensive conduct for comments he made in the same month.
