Court allows man to divorce wife he met on Facebook for being lesbian and denying him conjugal rights

A court in Nakuru County has annulled a five-year marriage where a man is accusing his wife of being lesbian. 

The two met on Facebook in 2015 and later married before their marriage went south.

The 30-year-old man, who had filed for divorce, told the court that he had suffered at the hands of his wife as she was denying him his conjugal rights.

In her ruling, Nakuru Principal Magistrate Yvonne Khatambi said that the marriage had already broken beyond reconciliation.

“The parties identified as FJO and PNM had failed to reconcile despite efforts to have them revive their five-year union,” Khatambi said.

She noted that both parties were no longer willing to proceed with the marriage. 

“I hereby dissolve the marriage between the petitioner and the respondent,” the Magistrate ruled. 

The man was allegedly disturbed that his wife had lost feelings for men and was now into women.

However, four years down the line things took a different turn and the woman who reportedly loved her husband started withdrawing from him.

In court documents, the man said that for eight months after their marriage, his ex-wife denied him conjugal rights.

According to the court papers, the man discovered his wife’s ‘identity’ through his sister.

“The respondent confided in my sister and my sister-in-law that she was only attracted to females. It was at this point that she disclosed she is a lesbian,” he said in the suit.

It is worth noting that the woman never attended all court hearings making the suit undefended.
