A middle-aged woman has been charged before a Mombasa court with allegedly orchestrating a land fraud involving property valued at Ksh100 million.

Farzana Nur Butt was arraigned before Senior Resident Magistrate Hon. Gladys Olimo to plead to three counts related to the fraudulent acquisition of land belonging to Susan Wanjiru Kangethe.

In the first count, she was charged with conspiracy to defraud, contrary to Section 317 of the Penal Code, jointly with others who were not before the court.

They allegedly conspired to defraud Susan Wanjiru of her parcels of land, LR. Mombasa/MS/Block 1/1944 and Mombasa/MS/Block I/1945, on diverse dates between July 12, 2006, and October 20, 2026, within the Coast Region.

The two parcels of land, valued at Ksh100 million and registered at the Mombasa Land Registry, were allegedly claimed without the authority of the registered owner.

Hon Olimo heard that the accused allegedly registered the same parcel in the name of her relatives Jamshed Ahmed Butt and Fahmeda Begum Butt, a fact she knew to be false.

In the second count of obtaining registration of land by false pretenses, contrary to Section 320 of the Penal Code, Farzana is accused of inserting Title Lease No. Mombasa/MS/Block 1/416 into the land records at the Mombasa Land Registry on July 12, 2006.

The accused allegedly committed the offence with intent to deprive Wanjiru of the two parcels of land situated in Likoni, Shelly Beach, by inserting the lease into the land records, a fact she allegedly knew to be false.

She was charged with the third count of forcible entry, contrary to Section 90 of the Penal Code, in which she allegedly forcefully entered the premises in Shelly Beach, Likoni, without the authority of the registered owner.

Hon. Olimo heard that the alleged offence occurred on diverse dates between July 9, 2025, and October 20, 2026, with the intention of annoying the registered owner.

The accused pleaded not guilty to all the charges.

Through her lawyer, she applied to be released on a reasonable bond term, saying she has a fixed abode within the jurisdiction.

Assistant Director of Public Prosecutions Breda Ogada, who prosecuted the case, urged the court to grant a bond term appropriate to the charges in question.

Hon. Olimo directed that the suspect be released on a bond of Ksh one million with a surety of a similar amount.

The court fixed the pre-trial conference for November 12, 2026.
