Through his lawyer, Judith Kamoing’, Kabu has petitioned Justice Janet Mulwa to compel Njoki to issue a public apology and retract alleged defamatory statements made on social media and other platforms.

“The apology should be issued through the same platforms used to disseminate the defamatory content,” Kabu stated in his petition. He is also seeking damages for libel, malicious falsehoods, and the harm caused to his reputation.

The petition outlines Kabu’s request for aggravated and exemplary damages to hold Njoki accountable for what he terms as “malicious, reckless, and deliberate actions.” Kabu claims the defamatory remarks have caused him significant mental anguish and embarrassment.

Additionally, Kabu has sought a permanent injunction to prevent Njoki from publishing or sharing any further defamatory statements through blogs, social media, or press conferences.

Kabu accuses Njoki of circulating an internal memo dated December 18, 2024, in which she allegedly made false claims about his conduct. The memo reportedly accused Kabu of conflict of interest, mismanagement, malice, inappropriate relationships with employees, and assault.

“The respondent falsely claimed that the plaintiff is not the founder of the company, resulting in gross insubordination among employees, loss of clients, and cancelled business engagements,” the petition reads.

The petition also states that the memo, which was shared with a WhatsApp group of 150 employees, accused Kabu of undermining the company’s operations by allegedly diverting clients and employees to a new business venture.

Kabu claims the memo was part of a broader scheme to oust him from the company and escalate employee dissent, creating a hostile work environment.

In addition to the memo, Kabu alleges that Njoki falsely accused him of gender-based violence, corruption, and other criminal activities. He further claims she suggested he had the capacity to enforce abductions, disappearances, and killings to silence dissenters.

Kabu has submitted various pieces of evidence to support his case, including transcriptions of CCTV footage from company meetings held in November 2024. In one instance, Njoki allegedly accused him of starting a rival company with another individual to create a conflict of interest.

Other allegations include claims that Kabu engaged in unethical “cartel-like” activities and sought to damage the company’s reputation.

Kabu also cited a social media post from December 6, 2024, as an example of defamatory content shared by Njoki.

The case is set to be heard inter-party on February 3, 2025.
