The office of Director of Public Prosecutions is seeking to cancel bond terms of Jowie Irungu after he allegedly assaulted a man in a club while drunk.
Through an application filed in court, the DPP claims that the matter was reported at Langata police station by one Rodgers Ochieng Okuta on March 7, 2021, at about 20:30 pm while in hotel 1824 that he physically assaulted him while having drinks at the club.
The DPP says that Irungu Jowie does not live with his parents as it was indicated to court before his release on bail but instead he lives in Nairobi working in a private security company and he is a frequent client at the club located in Langata area in Nairobi.
“That the accused has not only gone against the honourable court’s finding on the location or place of abode when honourable judge granted the bail terms by being away from Nakuru County. He continues to move and reside within Langata area being the secondary crime scene and the locality of the potential witnesses who have and are yet to testify” read the application in part.
The DPP further says that when the investigating officer met the area chief in Nakuru where his parents had indicated they will live with Jowie and assist them in the farm, the administrator had not forwarded the monthly reports to the Deputy Registrar of the high court about the attendance of Jowie as ordered by court.
While responding to the application by the DPP, Jowie’s lawyer David Ayuo told Justice Githua that the complainant in the matter who claims to have been assaulted withdrew the matter from the police station after they reached an agreement.
Ayuo also defended Jowie saying he is looking for means of survival since he has to cater for his one child and those of his aged parents that’s why he is working at the said private security company.
Jowie in his statement claims that he was too drunk that he couldn’t remember what happened at the club. That he can only remember being assisted into a taxi by his friend where he was taken to one of his siblings and later taken to Langata Hospital since he had a deep cut.
The ruling is scheduled for September 28, 2021.
Jowie Irungu is out on bond in the case where he is a suspect in the murder of businesswoman Monica Kimani alongside former TV reporter Jackie Maribe.
The case is coming up on October 4.
