Kimilili MP Barasa Threatens To Sue A Lawyer Over Facebook Post

Kimilili MP Didmus Barasa has threatened to institute legal proceedings against a former magistrate and lawyer Brian Khaemba. Barasa through his lawyer, John Khaminwa has written to Khaemba demanding him to apologise, desist from making any defamatory statements against the legislator in social media platforms, failure to which his lawyer has 14 days to institute legal proceedings.

In a demand notice by his lawyer dated August 18, Barasa says that Khaemba on March 24 2020 wrote a defamatory statement against him in social media which was meant to injure his character. “On the mentioned date you published on your Facebook page highly defamatory statements which were accessible to millions of people countrywide,” read the notice. “In the publication, you published numerous statements concerning our client which are entirely bogus, false and misleading and without any basis whatsoever,” Khaminwa wrote. Khaminwa averred that the assertions that purported to be true to his client in the discharge of his duties as a representative of his constituents were in fact harsh and unjustified attack on the lawmaker. “As a result, the publication amounted to gross and blatant misrepresentation of facts and a deliberate mischaracterisation of facts in our client’s nobility,” it read.null

The former Kiambu principal magistrate Khaemba has announced his intention to vie for Kimilili parliamentary seat, and the two during a burial ceremony in Kamukuywa ward traded tirades. As a magistrate, Khaemba while on sick leave gave anticipatory bail to former Kiambu governor Ferdinand Waititu who then faced corruption charges. Waititu was facing a Sh588 million corruption charges before the senate kicked him out. Khaemba gave orders on May 23 2019 by directing the Office Director of Public Prosecutions not to arrest and charge Waititu by giving the governor an anticipatory bond. Khaemba was to later be suspended by Chief Justice David Maraga on June 13 2019 for gross misconduct but was reinstated with full benefits but opted to resign a few days later and now tries his hand in courts as an advocate. In his Facebook page, Khaemba had cautioned the legislator against threatening to impeach Bungoma governor Wycliffe Wangamati for what he termed as abuse of office.

“I have read and listened to some clips wherein the MP for Kimilili is seen and heard questioning the integrity of Bungoma governor in discharging his duties. The disgruntled MP has gone ahead to threaten to impeach the governor in a few days to come,” reads the FB post. Khaemba reminds the lawmaker how he dubiously benefited by being awarded a contract to construct a bridge in Sirisia constituency. “The character has a brother who working as a chief officer in the office of the governor by the name Denson Barasa. If he truly believes Wangamati has integrity issues, let his brother resign from the county government administration,” read the post.null

“This fellow has popularly been sacked wherever he has worked due to his insatiable appetite for money, the last being Bollore Company where the company had to incur extra resources to put his name in dailies so that all and sundry could know that he had been sacked.” Khaemba further stated that Barasa was under investigation by the EACC, DCI and the PPRA for a number of malpractices in the management of NG-CDF and bursary funds for Kimilili constituency. “The gentleman also stole the rubber stamp of the fund manager which he used to award tenders for the construction of Matili and Chesamisi primary schools, so who is corrupt?” posed Khaemba.
