Yatha Bahati Josue, a Congolese national, has been granted Ksh 100,000 bail in the murder case of 28-year-old Kevin Omwenga who was slain in his Kilimani home.
In the ruling by Magistrate Sinyikan Tobiko, the acussed is to avail himself to investigators whenever required.
Tobiko said there was no compelling grounds established to remand the respondent for seven days.
The prosecution had presented Josue after he was arrested on Wednesday seeking to have him detained for seven days as they conclude investigations.
In their application, the procesution argued that if the accused is released, he could lead to interference of investigation and absconding.
Josue through his lawyer Samson Nyaberi however opposed the seven day detention seeking for the accused to be released on bail.
Josue’s arrest came after preliminary investigations revealed that the he, Chris Obure, Robert Bodo and the deceased were in constant communication.
According to the investigations, Josue is believed to have been involved in a deal gone sour that lead to the fatal shooting of the Omwenga.
During the time of the arrest, Josue, was in possession of a mobile phone, Samsung A10, which the prosecution intends to forward to cybercrime for forensic analysis.
The accused during the arrest couldn’t also give a satisfactory account of his work and source of income in the country. It was also revealed that he does not have a fixed point of abode.
This ruling comes shortly after the prosecution pressed more charges against businessman, Obure who is already facing murder charges.
In a charge sheet presented before the court, Obure is to be charged with two criminal counts among them failing to secure a firearm contrary to the firearms act.
He also faces another count of failing to secure the ammunition.
Meanwhile, his bodyguard Robert Bodo has been charged with two counts; possession of a firearm without a certificate and being in possession of ammunition.
Obure, however, did not appear in court to answer to the charges on Thursday. The court was told that he had been taken for a COVID-19 test.
His lawyers urged the court to postpone the plea taking to Friday.
Magistrate Tobiko agreed with the application and deffered the plea to Friday when Obure will be availed in court.
