DPP Given Three Days To Respond In Sh68 Million Cases Against Ex-Governor Evans Kidero

The Director of Public Prosecution Noordin Haji has been granted three days to order his responses in a suit in which former Nairobi Governor Evans Kidero is disregarding his case with irregular payment of Sh68 million to a law company.

Justice John Onyiengo suspended the hearing and permitted the DPP’s request, through Victor Owiti to be given three days to file their papers contradicting the case.

“We urge the court to give us three days to file our responses as this is a sensitive matter,” said Owiti.

Kidero, through lawyer Nelson Havi did not oppose the prosecution’s application.

Kidero insists that the case is biased and that the court must stop the criminal proceedings which he describes as an “abuse of the machinery of justice to cause injustice.”

He also insists that he was not in the Nairobi City Council when the information that led to the charges arose.

“It is ridiculous that I would be accused of co-operating to deceive the Nairobi City County of a valid and due debt of city council of Nairobi, which arose before my time in 2011,” he said in court reports.

“The case provoked by the suer, isn’t after the general public interest but for the  championing of a trumped up request and cause that is illegal.” Kidero adds

He is accusing the DPP of reapplying particular justice and behaving discriminatively.

“The petitioner has never been summoned or asked to answer to any questions in connections to the testimonies grounded against him or to submit any exculpatory proof as prescribed under the ACECA regulations (2013),” Kidero says in the declaration.
