The late Silas Ita’s widow has moved to court seeking to be enjoined in the petition by Justice Sankale Ole Kantai.
In the case, Justice Kantai obtained orders barring his arrest or prosecution in relation to the Tob Cohen murder and fraudulent transfer of Cohen’s business Partner’s Silas Ita’s share when he was in private practice.
Silas Ita was the late Tob Cohen’s business partner and the DCI has claimed that the judge transferred his share when he died to himself and later to Sarah Wairimu who was Cohen’s wife at the time.
Grace Naida Ita has filed an application seeking to be enjoined in the matter saying she is a victim.
Through lawyer Jennifer Kilonzo, Naida says she is the administrator of her late husband’s estate.
According to court records, Naida’s late husband was a good friend and business partner to Cohen in the company Tobs Ltd.
She claims that the DCI has linked Judge Kantai to the transfer of one share in Tobs Ltd by the judge and to also planning the murder of the late Cohen.
“Naida who is a victim of the criminal conduct of the judge is concerned about the controversy in the instant court proceedings and that unless the court entertains the application, the victim’s voices will be unlawfully muzzled,” the application reads
She further argued that it is unjust and unfair for the instant proceedings to continue in her absence as the administrator of the late Ita’s estate.
“Nadia has an identifiable interest in the criminal proceedings of the fraudulent transfer of a share in Tobs Ltd by the judge hence enjoining her in the proceedings will allow her access to justice for all benefits of the estates of the late Silas Ita,” reads court documents.
Last week, Tob Cohen’s sister made a similar application to be enjoined in the matter.
The case will be mentioned on October 13.
