Peter Salasya Unable To Pay Sh500K Debt As Required

A Kakamega businessman who allegedly lent Mumias East MP Peter Salasya Sh500,000 in 2022 has denied the MP’s plea to repay the bill in instalments.

Robert Lutta stated in his answering affidavit to Salasya’s plea to pay the amount in instalments that the MP has taken the court for granted.

Salasya applied on March 28 to postpone the execution of a warrant of attachment of his property issued by Lutta to recover the Sh500,000 debt.

A judgment had already been issued in Lutta’s favour.

The MP stated in court papers that he was unable to pay the entire amount at once due to other financial obligations.

“In my current financial position, I am unable to satisfy the whole decree at once due to my long-standing financial obligations that have committed my finances,” the lawmaker added.

However, in an affidavit, Lutta stated that the legislator was mocking the entire court procedure, from the filing of the petition until the entry of judgment.

Lutta, through Wafula Wawire & Company Advocates, stated that the MP requested and was granted a stay of execution of the judgment, which obliged him to pay him the amount, plus accrued interest and the cost of the matter, upon entry of judgment, but he never attempted to pay a dime.

“In my current financial position, I am unable to satisfy the whole decree at once due to my long-standing financial obligations that have committed my finances,” the lawmaker added.

Wawire appeared before Judge Caroline Cheruiyot during Salasya’s application hearing on Thursday. Cheruiyot scheduled the ruling for April 19, 2024.

Salasya went on to add in his Affidavit that he attempted to contact the respondent to repay the loan in instalments.

He had urged the court to enable him to pay Sh50,000 each month.

On November 27, 2023, G. Kiama delivered a judgment in favour of Robert Lutta, who had borrowed the politician Sh 500,000.
