The case of attempted murder of former Garissa Finance Executive Idris Mukhtar will proceed on February 8 and 9, 2022.
This is after a Nairobi court yesterday ordered the criminal case in which a businessman and woman are charged with the attempted murder to proceed without further delay.
Case was scheduled for hearing before Milimani Chief Magistrate Francis Andayi but it could not proceed because he has been transferred to another station.
However, the new Chief Magistrate Micheni Wendy ordered the case to proceed.
This was after prosecution and defence lawyers, led by Danstan Omari agreed to have the matter proceed.
Mohamud Hussein Aden, a businessman, and Juliet Njoki have denied attempting to kill Mukhtar on May 19, 2018 at his Kileleshwa residence in Nairobi.
The two have also denied another conspiracy to kill lawyer Charles Kanjama between July 1 and September 27, 2018 in Nairobi.
According to the prosecution, the accused persons, jointly with others not before court, attempted to kill Mukhtar by shooting him at White Star Restaurant on Kandara Road in Kileleshwa.
Mukhtar was admitted to Intensive Care Unit at a Nairobi hospital before he was flown to India for further treatment.
A man alleged to be a prime suspect died at the Parklands Police Station cells where he was being held for interrogation.
David Mwai, 27, allegedly committed suicide after recording a confession with detectives.
During investigations, police arrested several people among them Garissa Governor Ali Korane and his brother after they were mentioned adversely by witnesses.
Initial plan
Governor, his brother and others were released. But Mukhtar’s family insisted they were involved in the plot to kill their son since he had questioned the governor’s education.
Korane has denied any connection to the attempted murder.
According to investigators, Mwai, the assassin hired to kill the former Garissa finance boss, confessed to police the initial plan was to kidnap and poison Mukhtar but he took too long and instead was ordered to shoot to kill.
Mwai reportedly was unable to abduct and inject Mukhtar with hydrogen peroxide for three weeks.
Mwai told investigators how he was approached by a former schoolmate, who told him a friend wanted a man killed. The pay was to be Sh500,000.
