Businessman slapped with 23-year jail term for attempting to kill Ranalo’s William Osewe over woman

A city trader accused of attempting to kill Ronalo Foods restaurant owner William Osewe by shooting him has been sentenced to 23 years in jail.

Tom Mboya, who is a tour operator, was sentenced by Milimani chief magistrate Martha Mutuku on Wednesday after considering the probation report tabled in court.

Mboya was accused of shooting Osewe following a fight over a woman in 2016.

“I have considered the probation report tabled before me and noted that the accused Tom Mboya never showed any remorse for his offence,” the magistrate said.

The court also considered the impact of the offence on the victim, Osewe who was and still is adversely affected by the criminal act.

Lawyer William Ongoro represented the victim.

“I sentence the accused to 20 years in jail for the attempted murder charge and three years for wounding him,” she ruled.

The magistrate, however, ruled that the sentence will run concurrently which means Mboya will serve 20 years.

Last week the court found Mboya guilty after the prosecution proved its case beyond doubt that he committed the offence.

He was convicted for attempted murder and wounding Osewe.

Osewe had accused Mboya of sleeping with his wife.

While delivering the judgement, the magistrate noted that the offence of attempted murder is usually committed when there is an intention to kill.

“I have considered the evidence before the court and it is undisputed that Mboya shot Osewe,” she said.

The court noted that Mboya fired at Osewe several times as he shouted at him that he would shoot him.
