Inside Joho, Tycoon Boss Assets Frozen Ashok Dok Bitter Wars

The bad blood and business wrangles between Mombasa governor Ali Hassan Joho, tycoon Ashok Doshi and his wife Pratibha is far from over. Doshi has sworn to make sure Joho future is bleak. He has filed a suit seeking to have Joho barred from occupying public office. Doshi and his wife Pratibha in court papers claim, the governor breached Chapter six of the constitution by trespassing the property of the billionaire. Joho was in May this year sentenced to 60 days in jail – with the option of a Sh250,000 fine. He was convicted alongside Changamwe MCA Bernard Ogutu who was fined Sh250,000.

Hassan johoIn their court papers, the Doshis argue, Joho after being found guilty was proof that he did not show respect for the people and does not deserve to hold any elective post. “Joho and Ogutu have no morals to hold public office due to lack of good governance and transparency required to occupy such institutions. The respondents used the power and authority bestowed upon them as governor and MCAs to disregard and disobey a lawful court order,” read the petition in part. The war between the said parties started in 2019 when Doshi was raided by Mombasa county officers resulting in damage.

Ashok DoshiDuring his ruling, Justice Munyao Sila noted that leaders breaking the law in the name of enforcing rules were not setting a good example for the masses. The judge barred officers from Mombasa county from accessing the property. After the first ruling, Doshi moved to the High Court in Mombasa to order the arrest and jail of Joho for violating a court order. Also in the contempt court proceedings were county chief officer for Lands, Physical Planning and Housing Jaffar Mosheh and MCA Ogutu Ochieng. Doshi has sued Joho, Jaffer and Ochieng for revoking the title to his two-acre multimillion shillings prime land in Changamwe.

Pratibha Doshi“We pray the honourable court to summon Joho, Mosheh and Ochieng and commit them to six months in jail for contempt of court orders of March 6, 2019 and amended on April 9, 2019,” said Doshi’s lawyer Willis Oluga. During the court proceedings, Oluga produced a video clip reportedly showing Joho, Mosheh and Ochieng and other leaders at the disputed land supervising the demolition of the gate on the property. In the recording, Joho notes that the land belongs to the county government and as the president of the county he had revoked the title. It emerged, Joho paid 100 goons to destroy property with bulldozers and proceeded to bring down the perimeter wall and the gate estimated to cost Sh2 million. 

Bernard Ochieng OgutuAll was being done even after when on March 6 2019, Justice Ann Omollo granted orders stopping the county government of Mombasa from interfering with the said suit. Joho and his allies accuse Doshi of grabbing land belonging to Changamwe Secondary School. Documents Weekly Citizen has show Joho revoked the allotment that was done by former municipal council of Mombasa allocated to Turf Developers Limited. Turf Developers were original owners of the controversial land that Doshi purchased later. According to court documents, Doshi states, he purchased the land from Turf Developers Limited who had a government lease of 99 years with effect from December 1995 at an annual rate of Sh50,000.

Munyao SilaIn the case, Mombasa county is represented by lawyer Tajbhai Tajbhai who at one time claimed, at Joho did not issue orders to demolish a multimillion property. At one time, Doshi warned Joho of dire consequences for inciting Changamwe residents to damage a perimeter wall around his plot. According to Doshi, Joho was wrong to claim that his plot which he bought in 1999 was a grabbed property. The tycoon went further to claim, Joho was the least qualified to purport to be fighting land grabbing in Mombasa since he is an alleged perpetrator of the vice across the entire county. Doshi has accused Joho for not repossessing the grabbed portion of Mombasa Primary School and Nyerere Municipal estate in Kizingo and former Mombasa municipal council residential houses in Nyali whose grabbers are known to Joho.
