Matatu Tout Arraigned For Calling A Woman ‘Malaya’

A matatu tout with Tripple S SACCO was on Thurday, November 3 arraigned and charged with insulting a rival female matatu sacco driver.

George Kihiu Karanja is accused of calling Catherine Kabura Wangari a prostitute at Tom Mboya Street commercial bus stop.

Appearing before Milimani Senior Principal Magistrate Bernard Ochoi, Karanja pleaded guilty to using abusive words to Kabura in a public place with intent to provoke a breach of peace.

According to the charge sheet, the accused person on October 22, 2022 being a merchant with Tripple S SACCO, while along Tom Mboya Street, used abusive words to Kabura namely “malaya, mea ndevu“.

The prosecution through James Gachako informed the court that on the material day, the tout approached the complainant asking her to drive away as where she had parked belonged to another Sacco.

The complainant complied with the directives and drove her car to a different spot.

The court further heard that the accused person followed her and opened the driver’s door, pulled her out, and started insulting her.

At this point, two police officers from the traffic police who were attracted by the commotion approached the scene to calm the situation only for the accused person to flee.

The female driver was, however, advised by the police to report the matter at Central Police Station.

Tout pleads with court

The tout was later arrested after being identified by Kabura and arraigned in court.

When he appeared before Magistrate Bernard Ochoi, he pleaded guilty claiming that the economy is tough, and he was afraid the complainant might affect the movement of his matatu.

Karanja pleaded with the court to forgive him saying that he committed the offence out of anger and will not repeat the same in the future.

He further said that he has since apologised to the complainant, but her boss declined to have the matter settled out of court.

The magistrate, however, detained Karanja until November 7 and directed the probation department to file a pre-sentencing report when the court will issue the sentence.
