Former Chief Justice Dr Willy Mutunga can at last spill the beans on what exactly informed his three-minute ruling in the 2013 presidential petition. In wide-ranging Twitter posts, Dr Mutunga accused powerful forces, read (deep state) for having “coerced” his ruling. This was after he chaired a 6 judge panel hearing a presidential petition challenging the election of President Uhuru Kenyatta of Jubilee. The petition was filed by CORD presidential candidate Raila Odinga.
The Uhuru-Ruto Jubilee pair had won A closely contested presidential election, the first under the 2010 constitution, with a razor-thin 50+1 vote tally. But CORD candidate Raila Odinga claimed his “victory” had been “stolen” through widespread rigging and irregularities at several polling stations. CORD lawyers claimed massive rigging at the Bomas of Kenya main tallying centre.

But after a marathon 10 day hearing and tabling of evidence, Mutunga took a mere three minutes to dismiss the CORD petition upholding Kenyatta’s victory. A disappointed Raila waved aside the ruling saying he did not agree with it. Now eight years later Mutunga blames powerful figures or the “deep state.”
Mutunga, now a rabid civil rights crusader in the Katiba Watch says, unlike David Maraga who annulled Uhuru’s win in 2017, he did not have the luxury of an “independent” decision.

Mutunga claims his three-minute ruling was “coerced” with little left to the imagination as to what would happen if he ruled in favour of the opposition CORD petition. Mutunga says Maraga “defied” the “deep state” to overturn Uhuru’s win in 2017 but paid a heavy price. The judiciary has faced severe budget cuts during Maraga’s tenure and the bad blood has persisted.
